By 11am the piece, quoting various lawyers and the Liberal Democrat MP Tom Brake, had attracted 1044 comments. Most of those were not in sympathy, it’s fair to say, with the perceived point of the report. Of looters and rioters, one armchair jurist observed: “Some of these criminals do not deserve to be reformed.” The writer also questioned their right to breathe.
By that time, 2770 people had been arrested in connection with England’s upheavals. Of these, 1277 had appeared in court, with 64% remanded in custody. And yet, according to the BBC, the remand rate last year for serious offences for those appearing before English magistrates was just 10%. To a majority of those commenting, this seemed only to prove that the law was being applied “properly” – for once.
Meanwhile, Eric Pickles, England’s Secretary of State for Communities and Local Government, was touring the studios insisting that a radical shift in sentencing policy in courts supposedly free of political interference was merely reasonable, and only right. Magistrates had understood what was expected of them. (They had, after all, been explicitly asked to disregard normal sentencing guidelines.)
Two men had just been sentenced to four years for “inciting riots” via Facebook; another had been given 18 months after a stolen TV was found in his car. One young man was handed half a year for helping himself to a £3.50 case of water. Yet Theresa May, the Home Secretary – and “minister for equalities” – had already raised the possibility that entire city districts might in future be placed under curfew.
The Government had not declared a state of emergency. The Prime Minister had not invoked the 2004 Civil Contingencies Act, or taken the extraordinary powers the act allows. It just felt that way. In Manchester, 25% of the people charged were under the age of 18, but for those raging at the BBC – 1242 by 11.45am – these “feral” children were the most villainous of all, living proof of social breakdown, the enemy within.
