Health Care Law: Obama Administration Returns to Court

Lawyers for the Obama administration will again head to court to defend the law on the reform of health care, this time from challengers who claim it violates their religious freedom.

The Court of Appeals for the District of Columbia Court of Appeal will hear a fourth challenge to the Affordable Care Act (ACA) today.

The question is a key provision of the law, the individual mandate, which requires individuals to purchase health insurance by 2014 or pay a penalty.

The mandate was challenged in the courts.So far, an appeals court upheld it, another hit him, and a third rejected two challenges on jurisdictional issues.

The Obama administration has always maintained that Congress was well within its power to adopt the terms because the costs of health care across the country have been spiraling out of control.

The challenge in the DC circuit, Susan c. September-Sky Eric Holder, is led by a conservative religious group, accounting for four people.The group believes that the law violates the religious beliefs of members, and said that Congress had no power to force the market to buy health insurance when members believe that God will protect them.

While the ACA has some religious exemptions, some of the challengers of the law are not eligible.

Donald B.Verrilli, Jr., recently appointed by the administration Solicitor General says in his memoirs that the lower court judge was correct to dismiss the case. The administration claims that health care is a single market and that even if the plaintiffs in the case say they do not need health insurance, they can not ensure that the case of emergency may arise on the road where they need medical care that could cost thousands of dollars.
