The Bumpy Legal History of GPS Devices

When did people in this country develop a reasonable expectation of privacy over what they do in public? Until recently, at least, such a right did not exist.

No better pronouncement of this legal precept can be found than this seemingly all-encompassing quote from a 1967 U.S. Supreme Court decision, when it baldly stated, "[w]hat a person knowingly exposes to the public, even in his own home or office, is not subject to Fourth Amendment protection." , 460 U.S. 276 (1983).

There, a defendant bought a five-gallon drum of chloroform that could be used to manufacture illicit drugs.With the permission of the seller, the police installed a beeper in the drum cell containing a radio transmitter which sends periodic signals to a receiver in possession of law enforcement.

Police were able to track the movement of the drum for a period of time through a combination of visual and beeper surveillance transmissions. As the car carrying the container labeled began making evasive maneuvers, the tracking signal was lost for about an hour. When it was purchased, the container did not move and believed to be located inside a cabin.

The results of monitoring of the drum, coupled with other observations of the cab in the following days, were used to obtain a search warrant. Inside the cabin was a "fully functional laboratory illegal drugs."

The circuit court, in a split decision, has removed all evidence seized against Knotts as the fruits of the illegal electronic surveillance of the drum chloroform. It was found that the defendant's reasonable expectations of privacy had been violated because of the location of an object that was removed from public view and placed in a private space.

United StatesThe Supreme Court reversed, finding no violation of the Fourth Amendment in the beeper's ability to reveal the public transport of the drum or the rediscovery of it late once attaches to the inside of the cab.
